Man Dies In Fatal Hit-and-Run Motorcycle Accident

Hawaii News reports that a woman has been arrested in the death of a man killed in a fatal motorcycle accident. According to KHON Channel 2, the man was riding a motorcycle eastbound on the H-1 Freeway near the Waikele off-ramp when he was struck.

While initially the accident was considered a hit and run car crash, investigators now believe that the man may have been intentionally hit.

Whenever an accident occurs, several factors must be considered. First, all drivers involved in accidents resulting in serious bodily injury or death must immediately stop the vehicle at the scene of the accident, or as soon as is safe, and have a duty to give information and render aid. This includes such identifying information as their name, address, and driver's license information. The failure to stop and provide this information is a class B felony. Of course, if investigators determine that the driver of the SUV thought to have struck the motorcycle did so intentionally, then the driver may face much more serious charges of manslaughter or murder.

Further, even where criminal penalties arise, the surviving family members of a victim of a fatal accident may also be entitled to recover civil damages in a personal injury lawsuit for medical expenses, lost wages and emotional distress.
