Deadly Boat Accident Under Investigation

Hawaii News Now reports that the man responsible for the fatal Kailua boating accident is now under investigation and may face criminal charges. According to initial reports surrounding the accident, a man operating a 24-foot Zodiac vessel struck and killed a man off the shore of Lanikai Point. Witnesses to the tragic accident said the boat's driver had been speeding, despite laws requiring boaters to slow down when traveling within 100 feet of a swimmer or a diver's flag. That day, nearly there were about 225 people in the waters all along Kailua beach about the time the accident occurred according to records provided by city Ocean Safety officials.

The driver is now under investigation for negligent homicide, a charge typically reserved for drunk boating deaths, however in this instance alcohol does not appear to be a factor.

In addition to criminal charges, when boating accidents occur victims and their family member may be able to bring civil charges against the boat operator or other responsible party for injuries and damages sustained as the result of their actions.

Further, in the event of a wrongful death it may be possible to recover compensation for things such as funeral expenses, lost future earnings, medical expenses and even compensation for pain and suffering.
