Tragic Accident Involving Tour Bus Raises Questions of Safety

A 65-year-old woman was killed when she was run-over by a tour bus while crossing the street. The woman was in a marked cross walk when the tour bus struck her. Speed and alcohol do not appear to be factors. The driver of the bus, a 51-year-old male, is understandably traumatized. The driver, who worked for Travel Plaza Transportation, was en route to pick up passengers at a Waikiki hotel, and was approaching the intersection of Kona and Mahukona streets.

Many people familiar with the intersection note that it is particularly dangerous for both drivers and pedestrians, in part because it is not a four way stop, leading to confusion. Both roads are privately owned. Several questions have been raised concerning what can be done to increase safety on private roads, and at what point federal, state or local authorities will step in to enforce safety compliance laws. Where the design or maintenance of a road is a factor in the injury or death of an individual, the owner of the roadway may be guilty in a civil suit for roadway negligence.
