Fatal Car Accident May Lead to Civil and Criminal Charges

News reports that the driver in a fatal car accident in West Oahu may now face both civil and criminal charges as a result of the incident. According to sources, the driver of a minivan traveling westbound on Farrington Highway was driving erratically, then crashed into a concrete barrier, over a grassy median before running into two cars travelling eastbound. The driver of the first vehicle was pronounced dead at the scene, and the second sustained serious personal injuries and was taken to a nearby hospital for treatment. Speed and a medical condition may have been factors leading to the accident.

Investigators are looking into the possibility of both negligent injury and negligent homicide cases.

When serious motor vehicle accidents occur with injury, and negligent or reckless conduct exists, often both civil and criminal lawsuits may be viable. For example, a drunk driving accident with injuries may lead to both prosecution for DUI, and the driver may be responsible to pay civil damages to anyone injured because of his or her reckless/negligent conduct. The incident remains under investigation.
