State to pay $1.3M in motorvehicle accident

Hawaii news reports that the state has agreed to pay $1.3 million to a 23-year-old man who was paralyzed. The man was riding as a passenger in a vehicle when a car driving the opposite direction crossed the center line and struck his car. The man suffered serious injuries, including permanent paralysis.

In the personal injury lawsuit, the man asserted that roadway negligence on the part of the state contributed to his injuries. According to the complaint, and state was award of the dangerous condition of the road, but failed to repair and maintain it, including the failure to replace rumble strips on the road way that could have slowed the driver who hit him. A state, municipality or other entity may be held responsible for injuries that occur in motor vehicle and pedestrian accidents where the roadway is not properly maintained, or is designed in a way that increases the likelihood of an accident. The failure to install proper roadway signage or other safety features may also be factors in roadway negligence cases.

The award will cover past and future medical expenses, and lost earnings.
